What we can’t ask
The Fair Housing Act prohibits housing discrimination in regard to race, color, age, gender, country of origin, religion, familial status or disability. Some state and local laws also prohibit discrimination on the basis of sexual orientation. We have to be sure not to ask any prospective tenants any questions that seek to clarify any of these details unless we have already agreed to rent the property to them and are merely making conversation, such as asking “Where are you from?”

Be consistent
To protect you and ourselves against claims of discrimination when rejecting prospects, we are sure to perform the same review process for each possible tenant. That means doing all the same checks and asking all the same questions regardless of our comfort level with the prospect. Consistency not only protects us from occasional lapses in instinct and judgment, but it also clears us from any possible charges from wrongfully rejecting a possible tenant by singling them out for any of the above reasons.
